Terms of Service

By using Tortellini, you agree to these terms. We've written them in plain language because we think you should actually understand what you're agreeing to.
1. Service description
Tortellini is a decision engine for going out. It helps groups of friends decide where to go by ranking venue, timing, and deal combinations (“Moves”) based on occasion, group size, location, budget, and preferences.
Tortellini is:
- A recommendation and planning tool, not a booking platform.
- An informational service — we help you decide, but the decision to go is yours.
- A group coordination tool — we reduce the friction of planning, not replace your judgment.
Tortellini is not affiliated with, endorsed by, or responsible for any venue listed on the platform. We are not a party to any transaction between you and a venue.
2. Eligibility
You must be at least 18 years of age to use Tortellini. The service includes information about venues that serve alcohol and content related to alcoholic beverages. By using Tortellini, you confirm that you are of legal drinking age in your jurisdiction.
3. Your account
- You are responsible for maintaining the security of your account.
- You agree to provide accurate information when creating your account and to keep it current.
- One person, one account. Shared or automated accounts are not permitted.
- You are responsible for all activity that occurs under your account.
4. Acceptable use
You agree not to:
- Provide false or misleading information about yourself or a venue.
- Use Tortellini to harass, abuse, or harm other users or venue operators.
- Attempt to access another user's account, plan data, or private constraints.
- Scrape, crawl, or otherwise extract data from Tortellini through automated means without our written permission.
- Use Tortellini to promote illegal activity.
- Interfere with or disrupt the service, servers, or networks connected to the service.
- Submit misleading plan feedback or false venue reports.
5. Venue data accuracy
We go to significant effort to ensure venue information is accurate. Our data pipeline uses multiple sources and assigns field-level confidence scores to every piece of venue data (hours, specials, features, pricing). We display these confidence levels transparently.
However:
- Venue information can change without notice. Happy hour times, prices, and availability may differ from what is displayed.
- We label data with its freshness (e.g., “verified today,” “scraped 3 days ago”) so you can judge its reliability.
- When confidence in a data field falls below our threshold, we either label it “unverified” or do not display it. We do not present uncertain data as fact.
- We recommend confirming critical details (especially time-limited specials and large group capacity) directly with the venue before relying on them.
6. Plans and recommendations
- Move recommendations are informational. They represent our best assessment of what will work for your group based on available data, but they are not guarantees.
- Arrival confidence estimates (e.g., “walk right in” or “call ahead for 6+”) are based on historical patterns and available data. Actual conditions may differ.
- Plan data — including member constraints, commitment statuses, and messages — is ephemeral and auto-expires after 48 hours.
- Private constraints you provide within a plan are visible only to the plan creator, not to other group members.
- Tortellini is not responsible for the outcome of any night out, the quality of any venue experience, or the behaviour of any group member.
7. User content
User-generated content on Tortellini is minimal and ephemeral by design:
- Plan messages and feedback are tied to plans and expire with them (48 hours).
- Availability signals expire at 2am.
- Chat-to-Plan input is processed and discarded, not stored.
You retain ownership of any content you provide. By submitting content to Tortellini, you grant us a limited, non-exclusive licence to use it for the purpose of operating the service (e.g., displaying your plan messages to group members, processing your constraints to generate recommendations). This licence expires when the content is deleted.
8. Intellectual property
- Tortellini, including its design, code, algorithms, Move ranking engine, occasion scoring system, and brand identity, is owned by Tortellini.
- You own your personal data. You can export it or delete it at any time.
- Venue data sourced from public information and third-party APIs is used under the terms of those sources.
- You may not copy, modify, distribute, or create derivative works from Tortellini's platform, design, or content without written permission.
9. Privacy
Your use of Tortellini is also governed by our Privacy Policy, which describes in detail what data we collect, what we don't, how we use it, and how you can control it. Privacy is a core product principle, not an afterthought.
10. Limitation of liability
To the maximum extent permitted by Australian law:
- Tortellini is provided “as is” without warranties of any kind, express or implied.
- We do not guarantee the accuracy, completeness, or timeliness of venue data, despite our best efforts to maintain it.
- We are not liable for any loss, damage, or injury arising from your use of the service, reliance on venue information, or the outcome of any plan or night out.
- We are not liable for actions taken by venue operators, including changes to specials, pricing, hours, or capacity.
- Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim (which, for most users, is zero).
Nothing in these terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
11. Termination
- By you: You can delete your account at any time from your account settings. Deletion is permanent and includes a full data purge as described in our Privacy Policy.
- By us: We may suspend or terminate your account if you violate these terms, particularly the acceptable use provisions. We will provide notice where practicable.
- Upon termination, your access to the service ends and your data is deleted in accordance with our data retention policy.
12. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you via the app before they take effect. Continued use of Tortellini after changes take effect constitutes acceptance of the updated terms. If you disagree with a change, you may delete your account.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of Tortellini will be subject to the exclusive jurisdiction of the courts of New South Wales.
